***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.4 dated 15.04.2017 under Sections 419/420/193/467/468/471 and 120-B IPC at Police Station NRI, Bathinda.
Petitioner is arraigned as accused being attesting witness to sale deed No.329 dated 29.04.2016. He is incarcerated since 16.06.2017. Admittedly, case is triable by Magistrate.
Learned State counsel submits that charge has not been framed as yet, though, investigation is complete and challan is presented. Keeping in view that the case is triable by Magistrate, period of his incarceration and the fact that trial may take long time to conclude, no useful purpose would be served by detaining the petitioner. Accordingly, petition is allowed and the petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Bathinda.
