**** HARSIMRAN SINGH SETHI , J. (Oral) Learned counsel for the petitioner submits that the gratuity amount in respect of the service rendered by the late husband of the petitioner has not been paid to the petitioner which is causing prejudice to the petitioner.

Learned counsel for the petitioner further submits that keeping in view the policy which has been issued by the respondents-State qua the grant of the pension under Old Pension Scheme, the claim of the petitioner be examined as the selection of the husband of the petitioner on which post the husband of the petitioner was working is prior to 01.01.2006. 3.

Learned counsel for the petitioner further submits that the fresh representation claiming the said relief will be filed by the petitioner within the period of the 4 weeks from today and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner. 4.

Learned counsel for the respondents submits that in case, the petitioner filed a fresh representation with the authority concerned claiming RIYA 2024.03.04 10:50 I attest to the accuracy and integrity of this document

CWP-9528-2023 (O&M) -22024:PHHC:026460 the said relief recorded herein above, the same will be considered and an appropriate speaking order will be passed by the authority concerned within a period of eight weeks from the date of receipt of such representation and in case, after the decision, the petitioner is found entitled for any benefit, the same will be extended to him within a further period of four weeks. 5.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further with liberty to file a fresh representation with respondents as stated herein before. 6.
