Prayer is for grant of anticipatory bail in case FIR No.125 dated 26.08.2018 under Sections 409,120-B IPC and Section 13 (1) of Prevention and Corruption Act registered at P.S Sadar Fazilka. Allegations in the FIR are that the petitioner, who was Sarpanch of Village Karriawali received grant of Rs.44 lacs. Besides, there were panchayat funds amounting to Rs.30 lacs. The amount had not been spent on the development of the Village rather the same has been misappropriated.

Vide order dated 15.05.2019, this Court while granting the concession of interim anticipatory bail directed the petitioner to join investigation.

Learned State counsel, on instructions from ASI Mohinder Singh, states that though the petitioner has joined investigation, however, she is not cooperating with the investigating agency since the required record has not been produced by her.

Learned counsel for the petitioner states that the petitioner has joined the investigation twice. He has referred to document (P.8) as per MANOJ KUMAR 2019.11.06 09:32 I attest to the accuracy and integrity of this document

CRM-M-20838 of 2019 #2# which the complete record has been handed over to the Secretary Panchayat of Village Karriawali.

In view of above, the petition is allowed. The order dated 15.05.2019 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
