*** This petition for pre arrest bail has been moved by petitioner Jagtar Singh, an accused in F.I.R. No. 161 dated 15.10.2017 for offences under Sections 307/384/379-A/323/324/506/34 of the Indian Penal Code registered with Police Station Sadar Fazilka, District Fazilka. Briefly stated the facts of the case as per prosecution story are that on 14.10.2017 at about 5.30 P.M., complainant Amrik Singh son of Jaswant Singh, in the area of near link road village Jhandwala was assaulted by several persons causing him multiple injuries. On the basis of his statement, formal F.I.R. was registered.
Apprehending his arrest, the petitioner had moved an application for grant of pre arrest bail, which was declined, as such he has approached this Court seeking similar relief.
On notice, State counsel has put in appearance. I have heard learned counsel for the petitioner, learned State counsel besides going through the record.

CRM-M-41770 of 2017 The role attributed to the present petitioner is that he has raised lalkara and no specific injury has been attributed to him. He has since joined the investigation and has given an affidavit that he does not hold any Passport. Since the petitioner has joined the investigation, custodial interrogation is not found to be necessary. Therefore, the interim bail granted to the petitioner on 07.11.2017 is made absolute, subject to his fulfilling conditions under Section 438(2) Cr.P.C.
The petition stands allowed accordingly.
