Baldev Singh v. St. Of Haryana
CRM-M-10284-2001
IN THE PUNJAB AND HARYANA HIGH COURT
AT CHANDIGARH CWP-10284-2001 Decided on:14.05.2025 Baldev Singh and others .... Petitioners versus State of Haryana and another .... Respondents
CORAM:
HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA
Present:
None for the petitioners.
Ms. Tanushree Gupta, Deputy Advocate General, Haryana. Tribhuvan Dahiya, J. (Oral) The petition has been filed inter alia seeking a writ of mandamus directing the respondents to grant the benefit of increment to the petitioners on the basis of higher responsibility, though they were working in the higher/ promotional scale of pay prior to promotion as Head Teachers. 2.
It is not disputed at the Bar that the issue at hand stands decided against the petitioners by the Supreme Court in State of Haryana and another vs. Partap Singh and others, 2006(10) SCC 251, holding that the benefit of promotional/higher scale of pay is to be granted only once. If pay scale of promotional post has already been granted to an employee while working on a lower post, as it is the petitioners' case, he will not be entitled to any additional benefit on actual promotion to the higher cadre. 3.
In view thereof, there is no merit in the petition and it stands dismissed.
4.
Pending miscellaneous application(s), if any, stand disposed of as having been rendered infructuous.
