Petitioner moved second application before learned trial Magistrate seeking permission to examine hand-writing expert to prove his plea that he had no liability of `7,80,000/- towards the complainant and to get compared the hand writing over the cheque in question, which is basis of complaint. The application was declined.
Earlier similar application filed by the petitioner was declined vide order dated 17.01.2012. Admittedly, the petitioner had not challenged that order dated 17.01.2012, which has attained finality and the trial Court was not competent to review its own order, as such, impugned order passed by learned trial Court suffers from no infirmity. This petition has no merits. Dismissed.
