Instant petition has been filed under Section 528 of BNSS, 2023 (erstwhile Section 482 of Cr.P.C.), for seeking quashing of complaint under Section 138 of the Negotiable Instruments Act, 1959 (in short, 'NI Act') bearing registration No. NACT/1932/2022, and all consequential proceedings arising therefrom.

Since, only complaint has been challenged through instant petition, whereas, summoning order and dismissal of the discharge application has not been assailed by the petitioner with a specific prayer. Even summoning order, by which the petitioner has already appeared before the trial Court, is not part of the petitioner.

Therefore, present petition is disposed of with the observation that it will be open for the petitioner to file a fresh and appropriate petition by appending all the requisite documents, as mentioned here-above.
