The petitioners have filed this second petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.182 dated 10.8.2015 registered for the offences under Sections 406, 420, 408 and 120B IPC at Police Station Dera Bassi, District S.A.S. Nagar (Mohali). I have heard learned senior counsel for the petitioners and have gone through the record.
The first bail petition filed under Section 438 Cr.P.C. for grant of anticipatory bail has already been dismissed by this Court vide order dated 5.11.2015. In that order, it has been specifically written that the petitioners are required for custodial interrogation. Cr. Misc. No.M-41851 of 2015 [2] petitioners have not withdrawn the money from the account rather, the subsequent Truck Union has withdrawn the amount. All these facts are to be put and seen during the investigation by the Investigating Officer. This fact regarding necessity of the custodial interrogation has already been considered by this Court after perusing the Police record at the time of deciding the earlier bail petition.
Therefore, no ground is made out for grant of anticipatory bail in this petition and the same is dismissed.
