RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for issuance of direction to respondent No.2 to transfer the investigation to Crime Branch, Panchkula, Haryana or to some other independent agency out of District Nuh as the local police is not doing the investigation fairly in case FIR No.47, dated 05.02.2022, under Sections 376, 450, 506 IPC, registered at Police Station Nagina, District Nuh. Status report, dated 16.06.2022, by way of an affidavit of Satish Kumar, HPS, has been filed on behalf of respondent Nos.1 to 4. Learned State counsel has submitted, on the basis of the status report/reply, that the Investigating Agency is seriously carrying out the investigation wherein the medical of the prosecutrix has been conducted, statements under Section 161 Cr.P.C. and 164 Cr.P.C. have also been recorded and the report from FSL has also been received. He submits that the repeated raids are being conducted for arresting the accused, however, MEENU 2022.07.07 10:35 I attest to the accuracy and authenticity of this order/judgment

CRM-M-23458-2022 -2till date the accused could not be arrested. He further submits that the matter is actively under investigation and the accused would be arrested and the investigation would be completed at the earliest. After hearing the parties and perusing the status report, the petition is disposed of with a direction to the Investigating Agency to conclude the investigation at the earliest in accordance with law.
