M.M.S. BEDI, J. (ORAL) This order will dispose of the above noted two petition i.e. CRM-M-41998 of 2014 filed by Nachhattar Singh and others seeking quashing of FIR No.104 dated 8.11.2011, under Sections 323, 324 and 326/34 IPC, registered at Police Station Kot Bhai, District Sri Muktsar Sahib and another CRM-M-42004 of 2014, filed by Major Singh and others seeking quashing of cross case recorded under Sections 323 & 324/34 IPC recorded in above said FIR vide rapat No.10 dated 28.11.2011.

The FIR was registered at the instance of Bohar Singh alleging that the petitioners armed with stick, dang and gandas had assaulted the complainant and inflicted grievous injury whereas the cross case was recorded at the instance of Nachhattar Singh against Major Singh, Bohar Singh and Gurjant Singh. Both the parties have approached this Court for quashing of FIR and the cross-version on the ground that the matter having been amicably resolved, all the criminal proceedings be quashed.

The parties were directed to appear before the Judicial Magistrate First Class, Gidderbaha, to record the statement of both the parties and send a report that the matter has actually been compromised without any threat, coercion or undue influence. In view of the report received from the concerned Court that the matter has been compromised voluntarily without any pressure or coercion, following the judgment in case Kulwinder

Singh and others Vs. State of Punjab, 2007(3) RCR (Crl.), Page1052, both the petitions are allowed. The above said FIR as well as the cross-case and all the criminal proceedings emanating therefrom are hereby quashed on the basis of compromise. (M.M.S. BEDI) October 8, 2015.
