The present writ petition has been filed under Article 226/227 of the Constitution of India seeking issuance of a writ in the nature of mandamus directing the respondents to grant to grant the gratuity and other retiral benefits of the husband of present petitioner namely Jagdish Chand @ Jagdish Chander (LM Retd.), since deceased, by considering the date of appointment as 01.01.1987 instead of 23.10.1992. Further praying for directing the respondents to decide the legal notice dated 12.03.2026 (Annexure P-3) by passing a speaking order.

Learned counsel for the petitioner at this stage submits that he would be satisfied if a direction is issued to respondent No.3 to decide the legal notice dated 12.03.2026 (Annexure P-3) by passing a speaking order in a time bound manner in the light of judgments passed by this Court in Tek Ram Versus Uttar Haryana Bijli Vitran Nigam (UHBVN) and others, CWP-11537-2024, decided on 17.05.2024 (Annexure P-4), Bijender Singh Versus Uttar Haryana Bijli Vitran Nigam (UHBVN) and others, CWP11821-2024, decided on 24.07.2024 (Annexure P-5) and Sant Lal Versus Uttar Haryana Bijli Vitran Nigam and others, CWP-23275-2025, decided on 12.08.2025 (Annexure P-7).

Mr. Vikrant Pamboo, Advocate, appears and waives service of notice on behalf of the respondents and submits that he has no objection in the event this Court issues a direction to respondent No.3/competent authority to consider and decide the legal notice dated 12.03.2026 (Annexure P-3) in a time-bound manner, in the light of the judgments passed by this Court supra (Annexures P-4, P-5 and P-7) respectively. 5.

In view of the limited prayer made by learned counsel for the petitioners, and without commenting upon the merits of the case, the present petition is disposed of with a direction to respondent No.3/competent authority to consider and decide the legal notice dated 12.03.2026 (Annexure P-3) filed by the petitioner, by passing a speaking order in a time-bound manner, in the light of the judgments referred to hereinabove

(Annexures P-4, P-5 and P-7), within a period of two months from the date of receipt of a certified copy of this order. 6.

Needless to observe that, if the petitioner is found entitled to the relief sought, the same be granted to her forthwith by the respondents/competent authority, in accordance with law. 7.

Pending miscellaneous application(s), if any, shall also stands disposed of.
