This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.93 dated 31.10.2016 registered for the offences under Sections 307, 341 and 34 IPC and Sections 25 and 27 of the Arms Act at Police Station Sadar, Moga, District Moga. Notice of motion has been issued in this case. Mr. P.S. Grewal, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Punjab appearing for the respondentState and have gone through the record. Harpal Singh Parmar 2016.12.09 15:45 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-42834 of 2016 [2] First of all, this is a case of version and cross-version. As per the FIR, the petitioner was not armed with any weapon nor any injury is attributed to him. Only `Lalkara' is attributed to the petitioner. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that no useful purpose will be served by sending the petitioner to custody. Nothing is to be recovered from him.

Therefore, I accept this criminal miscellaneous petition and in the event of arrest, the petitioner shall be admitted to bail on his furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
