Present bunch of six petitions the details of which are mentioned in the heading, involve common point of law and common set of facts, hence, they are being dealt together.

Learned counsel for the petitioner-company submits that the petitioner-company intends to move an application for recalling the ex parte award dated 13.04.2023 (Annexure P-1) passed by the Labour on the ground that the petitioner-company was not served before the passing of the said ex parte award but the grievance of the petitioner is that after passing of the aforementioned exparte award, the execution has been filed and the executing Court is compelling the petitioner to execute the award in question. Hence, the Labour Court may kindly be directed to decide the application of the petitioner-company for staying of the exparte award as expeditiously as possible.

Keeping in view the facts and circumstances of the present case, as the petitioner-company is alleging that the petitioner-company was not served at the proper address before passing of the exparte award, the Labour Court is directed that in case, any such application is moved by the petitioner-company before the labour Court for recalling the exparte award

CWP-10352-2025 (O&M) AND CONNECTED CASES -3dated 13.04.2023 alongwith an application for interim stay, the same will be decide in accordance with law and by giving due notice to the parties. It is made clear that the Court is not expressing any opinon on the merits of the said application to be moved by the petitioner-company. 4.

Learned counsel submtis that the present bunch of petitions may kindly be disposed of having been not pressed any further with liberty as prayed for.
