The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.43 dated 30.5.2014 registered for the offences under Sections 411 and 414 IPC; Sections 18, 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the NDPS Act'); Section 25 of the Arms Act, 1959 and Section 3 of Indian Passport Act, 1920 at Police Station Jhandher, District Amritsar Rural.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the allegations in the FIR, 600 Grams intoxicant powder containing Nitrazepam has been recovered. The recovery falls in commercial quantity. Therefore, bar of Section 37 of the NDPS Act will apply in this case, hence, the petitioner is not entitled to the benefit of bail. Therefore, in view of the above discussion, I do not find any merit in this petition and the same is dismissed. October 04, 2018.
