Learned counsel for the respondents contends that the order dated 25.02.2019 (Annexure P-1), passed in RSA-436-1989, stands complied with. In pursuance to the said decision, a Committee was constituted and the case of the petitioners-plaintiffs was considered. Thereupon, order dated 26.08.2025 has been passed by the SDO (Civil)- cum-Allotment Authority, Ellenabad. Copy of the said order has been submitted in the Court today, which is taken on record. Faced with this, learned counsel for the petitioners wishes to withdraw the present petition with liberty to assail the findings of the aforesaid order dated 26.08.2025.
