Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.546 dated 26.09.2017, registered at Police Station City Fatehabad, District Fatehabad, under Sections 218 and 120-B of the Indian Penal Code and Sections 7, 8, 9, 12, 13(1) (d) and 13 (2) of the Prevention of Corruption Act, 1988.

Notice of motion was issued. Learned State counsel has appeared on behalf of respondent-State and contested the instant petition.

-2- CRM-M-42923-2018 From the record, I find that the allegation against the present petitioner is that he was one of the investigating officers and took money for falsely involving some persons. As per the prosecution version, the petitioner had taken `1,50,000/- from one Sikander and got discharged some persons by firstly nominating them in the FIR falsely. Challan has already been presented. The petitioner has been in custody since 08.05.2018. He is not required for any investigation or interrogation purposes as he is in judicial custody. The trial of case is likely to take a long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
