Petitioner has filed this petition under Section 482 Cr.P.C. for quashing of criminal complaint No.65/12 dated 15.01.2008 under Sections 499, 500 and 506 IPC and resultant proceedings arising therefrom.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the complaint has been filed against the petitioner by the respondent on 15.08.2008. The petitioner was summoned by learned Judicial Magistrate Ist Class, Kurukshetra vide order dated 30.09.2008. As per the version of the petitioner as stated in the petition, the petitioner was charge-sheeted on 07.09.2011.

CRM No.M-42065 of 2014 -2also admitted that two witnesses have already been examined after the charge, which means that the trial is going on and the Court has already taken the cognizance. It is not stated at the time of arguments that any revision has been filed against the charge. The mere fact that the trial has not been completed is no ground to quash the complaint. At this stage, neither there is anything to say that filing of the present complaint is abuse of the process of the Court nor there is anything to say at this stage that no offence is made out against the present petitioner.
Therefore, finding no merit in the present petition, the same is dismissed.
