It is not in dispute that the petitioner has not returned to India on or before 25.05.2017 in terms of order dated 18.01.2017. It is noticed that permission was granted to the petitioner to go to Australia for a period of four months vide order dated 18.01.2017. A demand draft for a sum of `5,00,000/- was deposited with the Registrar of this Court with a specific direction that in case the petitioner did not return by the stipulated period, the said amount of `5,00,000/- shall be released to the complainant - Roop Rani. As per the compromise dated 18.01.2017, it is specifically agreed between the parties that in case the petitioner did not return to India within the Omkar Singh 2018.02.08 14:02 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-42898 of 2016(O&M) -2stipulated period of four months, the said amount shall be released to the complainant-wife and it shall not be adjusted towards any claim which the complainant may have qua the petitioner.

Learned counsel for the petitioner fairly states that the petitioner has not returned to India till date. There is no application for extension of time etc. for his stay in Australia.

Accordingly, the said amount of `5,00,000/- lying deposited with the Registrar of this Court be released to the complainant - Roop Rani qua adequate proof of identity. It is clarified that the said amount shall not be adjusted towards any other claim which the complainant may have qua the petitioner.
