Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.209 dated 22.09.2014 under Sections 353, 186, 332, 427 IPC registered at Police Station Morinda, District Rupnagar.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. From the record, I find that the main accused Jaskeerat Singh is stated to have already been arrested in this case. CRM No.M-42115 of 2014 -2they are not required for custodial interrogation. The petitioners are not named in the FIR. No useful purpose will be served by sending the petitioners to custody.

Keeping in view the facts and circumstances of the case, and without discussing the merits of the case in minute details and without expressing any opinion on the merit of the case, I find it a fit case where petitioners are entitled to benefit of anticipatory bail. Therefore, the present petition is allowed. The order dated 10.12.2014 granting interim bail to the petitioners is made absolute.
