(Oral) Quashing of FIR No. 221 dated 30.08.2015 under Sections 306/354/506/511 IPC, registered at Police Station Sultanwind, District Amritsar, is being sought, on the basis of compromise deed/affidavit dated 01.03.2016 (P-2).
The allegations in the F.I.R are that petitioners tried to molest respondent No. 2 and her husband intervened to save her and thereafter, petitioners gave blows to them.
However, the matter has now been duly compromised between the parties, vide compromise deed/affidavit dated 01.03.2016 (P-2). In compliance of order dated 01.12.2016, report dated 17.03.2017 of Judl. Magistrate 1st Class, Amritsar has been received in this regard. As per report, statement of parties have been recorded. The complainant stated that the matter stands compromised between the parties and she does not want to proceed further against the accused and has no GAURAV ARORA 2017.04.07 12:38 I attest to the accuracy and integrity of this document Chandigarh
Crl. Misc. No. M-42955 of 2016 objection, if the present F.I.R be quashed against the petitioners. The compromise has been entered voluntarily. To the same effect is the statements given by petitioners.
Keeping in view the above status report dated 17.03.2017, the present petition is allowed and FIR No. 221 dated 30.08.2015 under Sections 306/354/506/511 IPC, registered at Police Station Sultanwind, District Amritsar is quashed along with all consequential proceedings, in view of the judgment of the Hon'ble Supreme Court in cases Madan Mohan Abbot vs. State of Punjab 2008(2) RCR (Criminal) 429 and the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs. State of Punjab and another 2007(3) RCR (Crl.) as no useful purpose would be served in prolonging the litigation. 30.03.2017 (RITU BAHRI) G Arora JUDGE Whether speaking/reasoned Yes Whether reportable No GAURAV ARORA 2017.04.07 12:38 I attest to the accuracy and integrity of this document Chandigarh
