This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 41 dated 09.05.2017 under sections 308, 325, 324, 323, 34 IPC at Police Station Sadar, Gurdaspur.

Admittedly, injury attracting offence under section 308 IPC is attributed to the petitioner. However, he is custody since 21.07.2017. Out of twenty six witnesses cited by the prosecution only two have been examined till now. Trial may take some time to conclude, thus, no useful purpose would be served by detaining the petitioner in custody during the pendency of trial.

Without expressing any opinion on the merits of the case, this court feels that petitioner deserves to be enlarged on bail. Accordingly, petition is allowed and petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate Gurdaspur and/or any other condition(s) as it may deem fit to impose.
