This is an application for preponing the date of hearing of the writ petition.

Mr. Mayank Aggarwal, Advocate accepts notice on behalf of respondent No.2. Mr. Aman Dhir, DAG Punjab accepts notice on behalf of respondent No.3. They state that they have no objection if the present application is allowed.

In view thereof, the present application is allowed and the date of hearing of the writ petition is preponed. With the consent of the learned counsel for the parties, the writ petition is taken on Board today itself. CWP-10642-2026 5.
On 08.04.2026 the following order was passed : 'Learned counsel for the petitioner would contend that vide notification (Annexure P-1), the land of the petitioner falling in village Mahitpur comprised in Rect. No.8//10/2/2 Min measuring approximately 01 Kanal 14 Marlas was acquired. As per demarcation report (Annexure P-4), respondent Nos.1 and 2 are in possession of 02 Kanals 14 Marlas of land. It is further the contention that since only 01 Kanal 14 Marlas of land was acquired and compensation has also been paid only qua 01 Kanal 14 Marlas of land, however, on the remaining 01 Kanal of land also respondent Nos.1 and 2 are now constructing. Notice of motion.
Mr. Akhil Kamra, AAG Punjab accepts notice on behalf of respondent No.3 and seeks some time to get his instructions.
Let notice be issued to respondent Nos.1 and 2, returnable 10.04.2026.
The petitioner is at liberty to serve respondent Nos.1 and 2 through the Panel counsel for Union of India'.

Today learned counsel for respondent No.2 states that he would have no objection if a fresh demarcation is carried out by respondent No.3 in the presence of the officials of respondent No.2. 7.
In view of the above, the present writ petition is disposed off with a direction to respondent No.3 to get a fresh demarcation carried out, after giving advance notice to the petitioner as well as respondent No.2, in accordance with law within a period of four weeks from today.
