(Oral) This is the second petition filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.82 dated 09.12.2016 registered under Section 307 read with Section 34 IPC, Section 323 IPC added later on and Sections 25 and 27 of the Arms Act at Police Station Sekhwan, District Gurdaspur.

The FIR is of December 2016 and earlier petition filed by the petitioner was dismissed as withdrawn.

Admittedly, the petitioner has been declared proclaimed offender, which is under challenge in Criminal Misc. No. M-41241 of 2018 and the same is still pending. A compromise has been arrived at between the parties and a petition for quashing of FIR on the basis of compromise has also been filed. The petitioner is not entitled for anticipatory bail being proclaimed offender.

The petition is dismissed.

Criminal Misc. No. M-43057 of 2018 -2However, in case, the petitioner surrenders before the trial Court within a period of one week from the date of receipt of certified copy of this order and moves an application for regular bail, the trial Court is directed to decide the same in accordance with law within a period of one week thereafter.
