(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.128 dated 29.08.2006, registered under Sections 323, 324, 148, 149 IPC (Section 326 IPC added later on), at Police Station City Gurdaspur (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise. Pursuant to orders dated 21.11.2018, 19.12.2018 and 13.03.2019 of this Court, the parties appeared before the trial Court on 12.04.2019 along with receipts of `25,000/- to get their statements recorded. Learned Chief Judicial Magistrate, Gurdaspur, has submitted his report vide letter bearing No.438 dated 22.04.2019 duly forwarded by learned District and Sessions Judge, Gurdaspur, vide Endst. CRM-M-43071 of 2018 --2-- Gurdaspur, is satisfied that the compromise is genuine, valid and without any pressure or coercion in any manner. No accused has been declared as proclaimed offender.
Considering the report of ld. Chief Judicial Magistrate, Gurdaspur, dated 22.04.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.128 dated 29.08.2006 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
Disposed of accordingly.
