CRM No.M-43019 of 2016(O&M) [2] Though mediation between the parties . failed, the petitioner and respondent No.2 have ultimately resolved their dispute amicably. They have decided to part ways. The terms and conditions of settlement have been reduced into writing. The settlement dated 10.07.2017, filed in Court today, is taken on record subject to just exceptions.

Learned counsel for respondent No.2 submits that in view of the settlement arrived at between the parties, he has no objection to the grant of anticipatory bail to the petitioner subject to the strict adherence to the terms and conditions of the settlement by the petitioner. Learned counsel for the State, on instructions from ASI Talwinder Singh, submits that the petitioner has joined investigation. Keeping in view the facts and circumstances as above, specifically the settlement arrived at between the parties but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 02.12.2016 is made absolute. Liberty is however afforded to respondent No.2 to move an appropriate application, in case the petitioner does not adhere to the terms and conditions of the settlement.
