Mr. Manoj Kumar Sood, Advocate, for the petitioner. Mr. Deepak Balyan, Addl. Advocate General, Haryana. **** This petition has been filed by the petitioner being aggrieved by the letter dated 10.04.2023 (Annexure P-8) whereby the petitioner's technical bid has been rejected and the authorities have proposed to grant the tender to respondent No.4.
Learned counsel for the petitioner submits that respondent No.4 was the only bidder in the fray and therefore, as per instructions and past practice of the respondents, such tender has to be cancelled as there is only one bidder remaining in the fray. He submits that the respondentauthorities have not followed this practice. The second contention is that though the petitioner has been found technically non-compliant, on the basis of same technical qualification the respondent-authorities have found the petitioner to be technically compliant in other tenders. It is, however, observed that the petitioner has directly approached this Court and has not approached the authorities in this regard. [2] On being confronted with this aspect, learned counsel for the petitioner submits that the petitioner will immediately approach the respondent authorities by filing a representation with regard to its grievances.
Learned Additional Advocate General appearing for the respondent-State of Haryana, on advance copy, submits that in case the petitioner approach the respondent-authorities by filing a representation within a period of three days, the authorities would consider and take a decision thereon in accordance with law before finalizing the tender proceedings, if not already finalized.
In view of the statements made by learned counsel for the petitioner as well as learned Additional Advocate General, Haryana and taking the same on record, the petition stands disposed of. It is, however, made clear that this Court has not expressed any opinion on the merits of the case.
