This petition has been filed under Section 407 Cr.P.C. read with Section 482 Cr.P.C. for transfer of the trial in FIR No.221 dated 12.08.2018 registered for the offences under Sections 186, 332, 34, 353 and 506 IPC and (Section 333 IPC, which was added later on) at Police Station Khol, District Rewari from the Court of learned Additional Sessions Judge, Rewari to any competent Court of jurisdiction or any other District within the state of Haryana as the respondent No.2 is an Advocate by profession in District Courts, Rewari and he being influential member in the Local Bar is not enabling any Advocate to pursue the matter on behalf of the petitioner. Learned counsel for the petitioner mainly argued that respondent No.2 is an Advocate by profession in District Courts, Rewari and is an influential member of the Bar.

Cr. Misc. No.M-20451 of 2019 [2] A perusal of the record shows that the FIR in the present case was got registered on 12.8.2018 and as per the record charges have been framed against the accused on 3.1.2019. The present petitioner is complainant and the trial is before the Court of Session and is to be conducted by the Public Prosecutor. The present petitioner is only to engage a counsel, if so desired, to help the Public Prosecutor. Otherwise also, in no way, it can be inferred that respondent No.2-Advocate has any influence on the Court. If that would have been the case, then the charges might not have been framed at the earliest. The apprehension of the present petitioner is ill-founded.

Therefore, from the above discussion, I find that there is no ground for transfer of the case and the petition is dismissed. May 06, 2019.
