Present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for issuance of directions to respondent Nos.2 to 4 to conclude the investigation of FIR No.126 dated 05.09.2023 registered under Sections 420 and 34 of Indian Penal Code, 1860 (for short 'IPC') at Police Station Chattiwind, District Amritsar Rural and to arrest accused persons i.e. respondent Nos.5 and 6.

Learned counsel for the petitioner contended that after the registration of FIR, more than 2 years have passed, neither the investigation has been concluded nor any report under Section 193 of BNSS has been filed. In this regard, the petitioner moved representations to respondent Nos.2 to 4 for conducting fair and proper investigation in the present FIR and for filing of report under Section 193 of BNSS qua respondent Nos.5, 6 and Sukhbir Singh, but no action has been taken so far. The petitioner also approached this Court

by way of filing a petition bearing CRM-M No.50909 of 2025 (Annexure P2), which was disposed of by a Co-ordinate Bench of this Court vide order dated 12.12.2025 with a direction to complete the investigation within a period of 04 weeks. As such, learned counsel prayed that the investigation of the present FIR be concluded and all the accused be arrested. 3.

Mr. Anup Singh, AAG, Punjab, present in the Court, accepted notice on behalf of respondent-State and submitted that one accused has already been arrested, challan qua him has also been presented and he has been released on bail; another accused is in custody in some other case and will be joined in the investigation, after procuring his production warrants; qua remaining accused, proceedings for declaring him proclaimed person/offender have been initiated, the investigating agency is also raiding the house of accused to arrest him and making its best efforts for proper investigation in the matter. Learned State counsel further submitted that investigation in the present FIR would be concluded shortly.

Learned counsel for the petitioner limited his prayer to the extent that investigating agency be directed to conclude the investigation in a fixed time bound manner.

Keeping in view the submissions made by learned State counsel and the limited prayer of learned counsel for the petitioner, and the fact that in the present case, FIR was registered about 21⁄2 years ago, so respondent No.3Senior Superintendent of Police, Amritsar is directed to look into the representation moved by the petitioner and investigation of the FIR be also

supervised by the officer not below the rank of Deputy Superintendent of Police and to conclude the investigation within a period of 03 months. 8.

Disposed of accordingly.
