The petitioner has invoked the inherent jurisdiction of this court u/s 482 Cr.P.C. for a direction to the Police Authorities to produce his son Kulpreet Singh Deol @ Neeta Deol before the Court of law as the media reports indicated that he has been arrested. The petitioner had an apprehension that his son might not be eliminated in any fake encounter. On notice having been issued to the respondents, an affidavit dated 1.12.2016 was filed on behalf of the DIG to the effect that the SIT had been constituted and that the son of the petitioner, who had escaped from the maximum security jail had not been arrested. Similar affidavit was filed by one of the members of the SIT on 2.12.2016. One affidavit dated 19.12.
2016 has been filed today to the effect that the son of the petitioner is still at large and has not been arrested though intensive efforts are being made by the SIT to apprehend him. An assurance/ undertaking has been given on behalf of the State that strict compliance in accordance with law will be made. The apprehension of the petitioner seems to be based on certain informations on the net, authentication of which is not feasible for this court.
The petition is disposed of with a direction that in case of arrest of Kulpreet Singh Deol @ Neeta Deol, he would be produced as per Section 26 of the Punjab Police Rules read with Section 57 Cr.P.C.
