(Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of F.I.R No. 113 dated 28.09.2016 under Section 67 of I.T Act and Sections 342/354-C/384/389/120-B IPC (473 of IPC added later on), registered at P.S. Dehlon, District Ludhiana. A bare perusal of order dated 01.11.2016 whereby the bail was declined to the petitioner shows that a sum of Rs.3,60,000/- is still in the possession of the petitioner, which is yet to be recovered. Today as well, learned counsel submits that nothing is to be recovered from the petitioner.
Keeping in view the fact that the petitioner is not ready to get the recovery effected and further the CD has not been recovered till date, no ground is made out for grant of anticipatory bail to the petitioner. Dismissed.
