(ORAL) Counsel for the petitioner states that when the petitioner retired from service on 31.05.2018 (Annexure P-1), there was a charge-sheet, which was pending against the petitioner, due to which, certain pensionary benefits of the petitioner were withheld and not released.

Counsel for the petitioner further states that a charge-sheet, which was pending on the day when the petitioner retired, was decided on 22.06.2018 (Annexure P-2) i.e. immediately within a period of one month from the retirement and only a punishment of censure was awarded. Counsel for the petitioner further states that after 22.06.2018 there is no impediment in the release of the pensionary benefits, still the same are not being released by the respondents. CWP-11763-2019 -2Counsel for the petitioner states that for the release of the pensionary benefits, petitioner submitted various representations dated 21.01.2019; 22.02.2019 and 20.03.2019 , which have been collectively attached as Annexure P-5 and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representations by passing an appropriate speaking order. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representations dated 21.01.2019; 22.02.2019 and 20.03.2019 (Annexure P-5 {Colly.}) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months. Present writ petition stands disposed of.
