The petitioners in CWP No.10305 of 2020 on the file of learned Single Judge of this Court have come up with this intra court appeal impugning the interim order dated 21.07.2020. The interim order would read as under:- "In the meantime, respondent No.5 shall not strike off the names of students, subject to their paying 40% of the composite fee, on monthly basis, in terms of letter dated 13.07.2020 (Annexure P-26) issued by District Education Officer, Gurugram, till the next date of hearing. Interim 40% monthly fee shall be paid on or before 5th of the every month."

LPA No.470 of 2020 -2Admittedly, the said order is not a final order. It is only an interim arrangement, which is considered by the learned Single Judge, keeping in mind the pandemic COVID situation in the country. Therefore, when we look at the order passed by learned Single Judge, we are of considered opinion that the same is just and proper, both on equity and law. Therefore, question of interfering with the same does not arise. If the appellants have got any inconvenience, they are at liberty to approach learned Single Judge for such modification as they would seek and the same would be considered by learned Single Judge, if necessary, in accordance with law.

With such observations, the present appeal is dismissed. As the main appeal is dismissed, all the applications pending render infructuous. Therefore, all such applications stand disposed of accordingly.
