Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.497 dated 28.12.2013 under Section 15 of the NDPS Act, registered at Police Station Pehowa, District Kurukshetra. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the allegations, a car was seeing lying in the ditches on the site of Thand, Pehowa Road, in accidental condition. On search 17 plastic bags of white colour containing 22 kgs. each were found. The Registration Certificate of the car was recovered from the car. It came during investigation that this vehicle has been borrowed by the present petitioner from the owner. At this stage, it cannot be held that the petitioner is not connected with the recovery. Section 37 of the NDPS Act bars the grant of bail to the accused in the case of commercial quantity. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
