(ORAL) Learned counsel for the petitioner submits that since the matter was amicably settled, petitioner was under a wrong impression that his presence in the court would no more be required. However, he came to be declared proclaimed offender behind his back vide order dated 30.1.2009 (Annexure P-2). When the petitioner came to know about the said order, he filed a revision petition which has also been dismissed by the learned revision court vide order dated 29.1.2015. He further submits that to put the controversy to an end, petitioner wants to surrender before the learned trial court to face the criminal trial. However, he prays for a direction to the learned trial court to consider the bail application of the petitioner keeping in view the attending circumstances which shall be brought to its notice, at the instance of the petitioner. CRM-M-42194 of 2015 After hearing learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, present petition is disposed of with a direction to the petitioner to surrender before the learned trial court within a period of 10 days from today and on his doing so, the learned trial court shall consider the bail application of the petitioner keeping in view all the attending circumstances, which shall be brought to its notice at the instance of the petitioner, by passing an appropriate order, strictly in accordance with law, at an early date.

With the abovesaid observations made and directions issued, present petition stands disposed of.
