MANJARI NEHRU KAUL, J. (Oral) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 62 dated 08.04.2019 under sections 304-B, 120-B IPC (offence under section 302 IPC added later on) registered at Police Station Patrana District Patiala. Custody Certificate of all the petitioner filed by learned State counsel through e-mail is taken on record. Office to tag the same at appropriate place.

Contends that it is a case of false implication inasmuch as there are no specific allegations leveled against the petitioner. Further submits that besides there being no specific allegations there is no direct evidence as well qua the deceased having been tortured by the petitioner. CRM-M-21157-2020 [ 2 ] Per contra the learned State counsel while opposing the submissions made by the learned counsel for the petitioner has submitted that as per the postmortem the deceased died due to Asphyxia. He further contends that besides that there were as many as seven injury marks were found on the person of the deceased. He, on instructions from SI Sandeep Singh, has submitted that the petitioner who was arrested on 05.04.2019 is the mother-in-law of the deceased and they were all residing together in the same house and till date only charges have been framed. In view of the above, no ground for grant of regular bail is made out.

The petition is dismissed.
