(ORAL) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of interim regular bail in FIR No.46 dated 04.05.2021, under Sections 22 of the NDPS Act, 1985 (Section 29 of the NDPS Act added later on), registered at Police Station Sadar Moga, District Moga. Learned counsel for the petitioner submits that in view of the fact that prosecution is unnecessary delaying the trial, as out of the total of 16 witnesses as cited by the prosecution, only 02 have been examined so far and, as such, he wishes to withdraw the present petition, so as to file afresh petition for seeking regular bail.

Allowed as prayed for.

Accordingly, the present petition is dismissed as withdrawn with aforesaid liberty.
