Learned State counsel informs that all the prosecution witnesses have been examined. After recording the statement u/s 313 Cr.P.C. four defence witnesses have also been examined. In view of the said circumstances, it will not be appropriate for this court to decide the present petition without prima facie appreciating the material available on the record. The said exercise might prejudice the right of the petitioner or the prosecution agency. Taking into consideration the stage of the trial, without expression of any opinion on merits of the case, the petition is dismissed, expecting that the trial would be finally decided within a period of one month after the next date of hearing, fixed before the trial court.
