(ORAL) Prayer in the instant petition under Section 438 read with Section 482 Cr.P.C. has been made for grant of anticipatory bail to petitioner Mushtaq Meer in case FIR No.49 dated 04.04.2017 under Section 22 of the Narcotic Drugs and Psychotropic Substances Act registered at Police Station City Hoshiarpur, District Hoshiarpur. According to the prosecution 35 grams intoxicant powder was recovered from the petitioner.

Earlier, vide order dated 18.07.2017 passed in CRM-M-24585 of 2017, petitioner was granted interim anticipatory bail till the receipt of FSL report. Now the FSL report has been received, according to which, the powder recovered from the petitioner has been found to be a narcotic substance.

Considering over-all facts and circumstances, petition is dismissed.
