(ORAL) prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner Arashdeep Singh in case F.I.R No.179 dated 29.08.2017 under Sections 323, 341, 148 and 149 IPC and lateron added Section 308 IPC registered at Police Station Bagha Purana, District Moga.

According to the prosecution, petitioner caused iron rod blow on the left ear of the complainant, which has been declared fatal and dangerous to life.

Learned counsel for the petitioner inter alia contends that the petitioner was earlier granted anticipatory bail. Three co-accused of the petitioner have also been enlarged on anticipatory bail. Now the police has added Section 308 IPC after 01 month and 04 days. No recovery has to be effected from the petitioner. Therefore, he is not required for any custodial interrogation.
