Mr. Sanjay Verma, Advocate for the petitioners. JASWANT SINGH, J (ORAL) The three alleged accused inter alia of an offence registered under Section 3 (1)(x) of Scheduled Castes/Scheduled Tribes Act, 1989 (for short "the Act") are seeking anticipatory bail.

Since there is a bar to the application qua provisions of anticipatory bail to the persons accused of an offence under the Act, learned counsel for the petitioners prays for withdrawal of the present petition filed under Section 438 Cr.P.C so as to file fresh one under Section 482 Cr.P.C read with Section 438 Cr.P.C.
