Crl. Misc. No.3940 of 2010 Custody certificate has been filed, which is taken on record. The present application filed under Section 397(2) Cr.P.C. is for suspension of sentence of the applicant-petitioner Surjinderjit Singh alias Vinod during the pendency of the revision petition. I have heard learned counsel for the parties and have gone through the whole record carefully.

Argues that the revision-petitioner has been convicted and sentenced to undergo rigorous imprisonment for 1 year with a fine of Rs.1000/- for commission of offence under Section 363 IPC. It has been stated that the applicant-petitioner has already undergone 2 months and 22 days out of total sentence.

Learned counsel for the State has not disputed these facts. The appeal will take time to mature. The applicant-petitioner has already undergone 2 months and 22 days out of total sentence. Hence, in view of these facts and without expressing any opinion

Criminal Misc.No. 3940 of 2010 in Criminal Revision No.218 of 2010 -2on the merits of the case, the application for suspension of sentence of the applicant-petitioner Surjinderjit Singh alias Vinod is accepted and the remaining sentence of the applicant-petitioner is suspended during the pendency of the revision-petition.
