**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 0335 dated 14.9.2018 under Sections 20 and 22 of Narcotic Drugs and Psychotropic Substances Act, 1885 registered at Police Station South Sector-34, Chandigarh.

Learned counsel for the petitioner submits that petitioner is in custody since 14.9.2018. He further submits that 12 injections Buprenorphine and 12 injections Pheniramine Maleate 10 ml each alleged to have been recovered from the petitioner are marginally above the commercial quantity whereas the alleged recovery of 1040 grams Ganja is of non-commercial quantity.

Learned State counsel has pointed out that the earlier petition filed by the petitioner seeking regular bail was dismissed on merits on 17.1.2019.

CRM-M No. 21435 of 2019 -2Custody certificate dated 7.1.2020 by way of Amandeep Singh, Deputy Superintendent, Model Jail, Chandigarh has been filed which is taken on record. As per the custody certificate, no other case is pending against the petitioner.

The petitioner is in custody since 14.9.2018. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on her furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
