(Oral) Learned counsel for respondent no.1, on instructions, states that he does not press for the amendment of issue no.5A, which was amended vide impugned order dated 05.09.2018 (Annexure P-8), and that he would be satisfied if the issue as framed earlier on 20.05.2015 i.e. "5A. Whether the suit property is ancestral property ? OPP" is maintained. Faced with the same, learned counsel for the petitioner states that he does not wish to pursue the present revision petition. The revision petition is dismissed as not pressed. It is made clear that Issue No.5A shall now be read as the unamended one i.e. "Whether the suit property is ancestral property? OPP" as framed on 20.05.2015.
