For having been found in possession of 8 injections of Buprenorphine containing 2 ml each, the petitioner has been in custody since 19.9.2015. Report dated 8.,3.2016 has been received from Chief Pharmacist to the effect that the total weight of 8 Buprenorphine injections, recovered from the petitioner, would be 16 grams against 20 grams, prescribed as commercial quantity.

Taking into consideration the fact that non commercial quantity of drug has been recovered from the petitioner, he can be granted the concession of bail.

The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to the condition that the petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial. In case of any such eventuality, it will be open to the prosecution agency to seek cancellation of bail. March 11 ,2016 ( M.M.S.BEDI ) TSM JUDGE
