The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking issuance of a writ of mandamus, directing respondents No.2 & 3, especially respondent No.3 to operate the merit list (Annexure P-5) prepared pursuant to the advertisement dated 25.09.

2024 (Annexure P-1) for the post of Staff Nurse and to fill up the vacancies arising due to non-joining of selected candidates and consequential vacancies arising from migration of meritorious reserved category candidates, by offering appointment to the next candidates in order of merit, including the petitioner; to consider the candidature of the petitioner for appointment to the post of Staff Nurse in accordance with her position in the Backward Class merit list and to complete the recruitment process initiated pursuant to the abovesaid advertisement. Further, prayer has been made to stay the operation of the fresh advertisement (Annexure P-8) and restraining respondents No.

2 & 3 from proceeding with or filling up the said posts through any fresh recruitment process during the pendency of the present writ petition without first exhausting the merit list prepared pursuant to the abovesaid advertisement.

Learned counsel for the petitioner submits that for redressal of her grievances, the petitioner has also served justice demand notice dated 24.02.2026 (Annexure P-9) to the respondents which is still pending consideration. Notice of motion restricted to respondents No.1 & 3 only at this stage.

Mr. Satnampreet Singh Chauhan, D.A.G., Punjab, accepts notice on behalf of respondent No.1-State. On receipt of advance copy of the petition, Mr. Shailesh Aggarwal, Advocate has put in appearance and accepts notice on behalf of respondent No.3. They have no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to consider and decide justice demand notice dated 24.02.2026 (Annexure P-9) submitted by the petitioner expeditiously, by passing a speaking order after affording an opportunity of hearing to the petitioner, preferably within a period of 02 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioner.
