(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.66 dated 19.09.2018 (P-1), under Sections 353, 186, 148 and 149 IPC, Police Station Sekhwan, District Gurdaspur and all subsequent proceedings arising therefrom, on the basis of compromise dated 25.09.2018 (P-2).
Pursuant to order dated 15.01.2019 of this Court, the parties appeared before the trial Court on 06.03.2019 along with receipt of `15,000/- to get their statements recorded. Learned Judicial Magistrate (First Class), Batala has submitted his report vide letter bearing No.58 dated 06.03.2019 duly forwarded by learned District and Sessions Judge, SONIKA 2019.03.11 16:47 I attest to the accuracy and authenticity of this document Chandigarh Gurdaspur, vide Endst. No.4226/R7 dated 07.03.2019.
CRM-M-43312 of 2018 --2-- According to the report, ld. Judicial Magistrate (Ist Class), Batala is satisfied that compromise arrived at between the parties is genuine and valid one.
Considering the report of ld. Judicial Magistrate (Ist Class), Batala dated 06.03.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.66 dated 19.09.2018 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
Disposed of accordingly.
