This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.512 dated 7.7.2016 registered for the offence under Section 20 of Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station City Ballabgarh, District Faridabad.
Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition. Police record has also been produced. Cr. Misc. No.M-43264 of 2016 [2] State and have gone through the record.
As per the allegations in the FIR, 1 Kg. 800 Gram of `Ganja' has been recovered from the present petitioner which falls in noncommercial quantity. The petitioner has been in judicial custody since 8.7.2016. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `30,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
