*** ANIL KSHETARPAL, J (Oral) The hearing of the case was held through video conferencing on account of restricted functioning of the Courts. This application has been filed by the wife with a prayer to transfer the proceedings in case bearing No.GW/63/2020 (Mandeep Singh v. Randeep Kaur) pending before the Family Court, Bathinda, to the Court of competent jurisdiction at Sri Muktsar Sahib.

The petitioner claims that the respondent is already defending two proceedings at Sri Muktsar Sahib i.e. trial of FIR No.297, dated 14.11.2019 and a petition under Section 125 Cr.P.C. She further claims that she is maintaining two minor children born out of the wedlock. The elder son is 6 year old and attends school at Sri Muktsar Sahib. Learned counsel for the respondent contends that the matter be sent to the mediation center.

TA-563-2021 (O&M) proceedings in case bearing No.GW/63/2020 (Mandeep Singh v. Randeep Kaur) pending before the Family Court, Bathinda, are ordered to be transferred to the Court of competent jurisdiction at Sri Muktsar Sahib. The transferor Court is requested to remit the case file to the transferee Court forthwith. The parties are directed to appear before the District Judge, Sri Muktsar Sahib, on 06.10.2021 who shall assign it to the Court of competent jurisdiction at Sri Muktsar Sahib.

The respondent shall be at a liberty to file an application before the Court at Sri Muktsar Sahib for referring the matter to the Mediation center which will be considered sympathetically. All the pending miscellaneous application(s), if any, are also disposed of.
