CWP No.12125 of 2021 115 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Civil Writ Petition No. 12125 of 2021 (O&M) Date of decision : 28.07.2021 Ashish

Versus

State of Haryana and another ... Respondents Coram :

Hon'ble Mr. Justice Arun Monga Present :

Mr. Rajesh Nain, Advocate, for the petitioner. Mr. Saurabh Mohunta, Deputy Advocate General, Haryana. (Presence marked through video conference) Arun Monga, J. (Oral) Apropos order dated 08.07.2021, passed by this Court, learned State counsel submits that the instant petition is premised on self-acclaimed assessment that petitioner has secured 69 marks (64 marks in written and 5 for socio-economic category), whereas, as per the result declared by the Haryana Staff Selection Commission, he has secured only 67 marks (62 marks in written examination and 5 for socio-economic). He further submits that the last selected candidate has secured 69 marks (64 marks in written and 5 for socio-economic category), in the category in which the petitioner has applied, therefore, the petition is liable to dismissed. He argues that no candidate having lesser marks than the petitioner has been given any appointment letter, as is being contended by learned counsel for the petitioner.

Learned counsel for the HSSC/State further points out that the petition has been filed on the basis of unrevised answer-key (Annexure PVARINDER SINGH 2021.07.28 17:25 I attest to the accuracy and integrity of this document Punjab & Haryana High Court at Chandigarh

CWP No.12125 of 2021 4), whereas subsequently, there was another revised answer-key, which was though not uploaded on the website.

Confronted with the above situation, learned counsel for the petitioner submits that the petitioner did not have access to the revised answer-key, therefore, there was no occasion for him to do his selfassessment as per the revised answer-key. Be that as it may, to the extent that the revised answer-key was not uploaded on the website, the grievance of the petitioner is genuine and it is expected of the Haryana Staff Selection Commission to upload the revised answer-key within four weeks from today.

No ground to interfere is made out. However, the petition is disposed of with liberty to the petitioner to seek appropriate remedy, in accordance with law, in case his result is not in conformity with the revised answer-key.
