HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.193 dated 24.09.2019 under Section 22 of NDPS Act registered at P.S City Jagraon, District Ludhiana.

A perusal of FIR reveals that 1120 intoxicant tablets of Diphenoxylate Hydrochloride & Atropine Sulphate Tablets IP consisting of 141 grams of Alprazolam and 63 grams of Diphenoxylate Hydrochloride were recovered from the possession of the petitioner. Learned counsel for the petitioner contends that the petitioner has falsely been roped in due to party faction in the village. The petitioner is in custody since 24.09.2019 and the trial is not making any headway due to covid-19 pandemic and that no other criminal case is registered against the petitioner.

Opposing the petition, the learned State counsel, on instructions from ASI Surender Singh, has submitted that the investigation is complete and the challan has been presented.

Without commenting anything on the merits of the case and also bearing in mind the custody period of the petitioner, in my opinion, no MANOJ KUMAR 2020.10.26 18:40 I attest to the accuracy and integrity of this document

Crl.M.No.21170 of 2020 #2# useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Gurmeet Singh is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
